ARGUMENT
Registration Refused – Mark is Primarily Merely a Surname
While Applicant admits that SMITH is a commonly used surname, in the context of this
application, the relevant consuming public would just as likely believe that SMITH is used in its
common dictionary definition, namely a tradesperson (see, attached Exhibit A, definition of
smith from Websters at yourdictionary.com). In that regard, while it is a surname, the mark is
not primarily merely a surname. Accordingly, the mark should be registrable on the principal
register and the rejection under Section 2(e)(4) should be withdrawn.
Anyone Connected with Applicant has the Mark as a Surname
Applicant states for the record that neither applicant nor applicants original founders has the
mark as a surname.
Mark Has any Recognized Meaning Other than as a Surname
The Examining Attorney has specifically asked whether the mark has any recognized meaning
other than as a surname. As stated above, applicant submits that the term smith is defined as a
tradesperson, for example, a silver smith, an iron smith, etc.
