RESPONSE TO OFFICE ACTION DATED APRIL 23, 2009

The Applicant, Retirement Strategies, LLC (“Retirement Strategies” or “Applicant”),

respectfully submits this Response to the Of?ce Action dated and e-mailed April 23, 2009.

RECITATION OF SERVICES

The Examining Attorney has determined that “[t]he identi?cation of services, although

previously acceptable, is currently inde?nite and overly broad ….” Of?ce Action at 2. The

Examining Attorney has asked the Applicant to identify the services with more speci?city. Id.

The Applicant adopts the following recitation in International Class 36:

“Creation and administration of employee bene?t plans concerning insurance and

finance.”

REMARKS

The Examining Attorney has found no registered mark that would bar registration, but

has cited a prior-?led pending application, Serial No. 77437301, as a potential impediment to

registration. Applicant believes there is no potential con?ict between its application and the

earlier~?led application, but Applicant elects not to submit arguments at this time. Applicant’s

election is in reliance upon the statement in the Of?ce Action that “the election not to submit
arguments at this time in no way limits applicant’s right to address this issue at a later point.”
