Please note that we wish to insert the following disclaimer in order to remove any
confusion as to the intentional misspelling of JEAN as GENE as follows:
No claim is made to the exclusive right to use JEAN
apart from the mark as shown.
If this disclaimer will satisfy the Trademark Office in regards to any confusion from the
above intentional misspelling, we ask for your continued review of our petition and
approval as soon as possible.
Regarding other similar marks, we have enclosed sample products which will bear
the above mark. The two other filed and possibly conflicting marks are discussed below:
STUDIO R.P & DENIM: The owners of this mark concentrate on strictly denim
bottoms products for a female demographic. Our products are strictly for young men
demographic and would not ever be confused. (Studio R.P product sample enclosed)
RP: This mark is for a maternity wear brand. Our product, besides being used in the full
RP GENE is marketed towards a young mens market as sportswear and will never be
in conflict or ever be mistaken for Rosie Pope Maternity.
Please review the enclosed and if the USPTO should require any additional
information or documentation, we would be more than glad to submit such.
