Dear Sir/Madam:

This is in response to the Of?ce Action dated January 27, 2010.

REMARKS

The Examining Attorney previously accepted the present description of services,
which included “facilitating the exchange of use times and vacation ownership rights for
vacation time share real estate,” but in the Of?ce Action dated January 27, 2010 said that
description of services was unclear and requested amendment. The Examining Attorney
is requested to reconsider the requested change.
The present description is the same description used by Applicant and accepted by
the Trademark Of?ce in Registration No. 2490166 for “Trading Places International.” It
is also the same description used by Applicant and accepted by the Trademark Of?ce in
Registration No. 2490165 for “Premier Access.” Copies of the TESS printouts are
attached for reference.
Further, Registration No. 3699494 for “Ritz Carlton” includes services described
as “real estate brokerage services, namely, facilitating the sale, exchange and trade of
resort and vacation time for members of resort recreation clubs.” Registration No.
3198082 for “Trading Stories” uses the following description of the services: “real estate
time-sharing, namely, organizing and facilitating exchange of use of fractional ownership
properties; vacation real estate time-sharing. Finally, Registration No. 2718030 includes
the description “facilitating the exchange of use times and vacation ownership rights for
vacation time share real estate, and arranging for sales and trades of vacation time share
real estate.” Copies of the TESS printouts are attached for reference.
The present description is thus believed to be suf?ciently clear for registration,
especially as it is used by others in the trade and has been recognized as suf?ciently clear
by the Trademark Of?ce.
The services are believed to be in the correct class. As re?ected by the
description, Applicant helps persons who own properties or time shares, to exchange the
use of their property or their time share with others. Thus, for example, if you have a two
week vacation time share in Hawaii in the winter, you can exchange it for two weeks in
Vermont and go skiing.
In view of the above explanation, the Examining Attorney is respectfully
requested to pass the application to publication. If there are any further questions on the
