RESPONSE TO OFFICE ACTION
Applicant, Wyeth, submits this response to the Office Action dated April 30, 2007 with
respect to TRUE SHIMMER (or the Mark) shown in Application Serial No. 77/094778.
1. Section 2ge1g11 Descriptive Refusal
The Examining Attorney has initially refused registration of Applicants proposed mark
TRUE SHIMMER (Mark) under Trademark Act Section 2(e)(l), 15 U.S.C. § 1052(e)(1)
because she believes the Mark merely describes a feature of the goods.
Applicant respectfully submits that its Mark is suggestive and not merely descriptive
because it does not immediately convey information concerning a significant feature of
Applicants goods. Rather, it requires a multistage reasoning process to reach a conclusion as to
the nature of Applicants goods. Also, Applicants Mark represents a double entendre
susceptible of multiple non-descriptive interpretations in relation to Applicants goods, further
supporting that it is suggestive. Moreover, there are numerous third party U.S. trademark
registrations on the Principal Register that contain the term TRUE together with another
descriptive term and it has long been the practice of the United States Patent and Trademark
Office to pass to publication TRUE marks used along with other descriptive terms because of
the many meanings and connotations of TRUE.
For all of the above reasons, Applicants Mark should not be denied registration on the
grounds that it is merely descriptive. Accordingly, Applicant respectfully requests that the
Examining Attorney reconsider her opinion and allow this application to be published.
A. TRUE SHIMMER Does Not Immediately Convey Information Concerning a
Signi?cant Feature of Applicants Goods and Therefore
Should Not Be Denied Registration as Merely Descriptive
A mark is merely descriptive and will be refused registration if it immediately conveys
information concerning a significant quality, characteristic, function, ingredient, or feature of the
goods. See In re MBNA America Bank, NA, 340 F.3d 1328, 67 U.S.P.Q.2d 1778 (Fed. Cir.
2003), reh g and rehg en banc denied, (Jan. 12, 2004) (holding that marks MONTANA SERIES
and PHILADELPHIA CARD used in connection with credit card services immediately convey
information about a specific regional affinity, or the user group to which services are directed);
In re Gmlay, 820 F.2d 1216, 3 U.S.P.Q.2d 1009 (Fed. Cir. 1987) (holding that mark APPLE PIE
is merely descriptive of potpourri because mark immediately conveys information about
potpourris scent); In re Bed & Breakfast Registry, 791 F.2d 157, 229 U.S.P.Q. 818 (Fed. Cir.
1986) (holding that BED & BREAKFAST REGISTRY is merely descriptive of lodging
reservation service that maintains registry of lodgings because registry is essential element of
applicants services); TMEP § 1209.0l(b). The perception of the relevant purchasing public sets
the standard for determining descriptiveness. E In re Nett Designs, 236 F3d. 1339, 1341 (Fed.
Cir. 2001). Thus, a mark is merely descriptive if the ultimate consumers immediately associate it
with a quality or characteristic of the product or service. ?. Conversely, a mark is not merely
descriptive if it requires imagination, thought or perception to reach a conclusion as to the nature
of the goods at issue. Id.
In the instant case, the Examining Attorney refused registration on the basis that
Applicants Mark merely describes a feature of Applicants goods. In support of her position
that the relevant purchasing public will immediately associate the Mark with a feature of
Applicants goods namely, lip balm, the Examining Attorney relies on only two definitions of
each of the terms that comprise the Mark. According to the Examining Attorney, the term true
describes something that is genuine or precise and the term shimmer describes a gloss or shine.
Therefore, true shimmer would be understood to describe a product that has a precise gloss.
In reaching this conclusion, the Examining Attorney simply ignores a myriad of
definitions of the terms that are re?ective of the publics understanding of the terms and thus the
Mark as a whole. For example, according to Dictionary.coms online dictionary, true has
numerous common defi niti ons incl udin g: gen uin e, stea dfas t, and prec ise. See pag es fro m
www.clictionar .corn attached hereto as Exhibit A.
In light of the multiple definitions associated with the terms comprising Applicants Mark
that shape con sum er per cep tio n of the Mar k as a who le, a con sum er con fro nte d wit h App lic ant s
Mark in connection with Applicants goods likely will be left wondering what TRUE
SHIM ME R is and ho w it rel ate s to App lic ant s goo ds of lip bal m. Con tra ry to the Exa min ing
Attorney s asse rtio ns, a pote ntia l con sum er alm ost cert ainl y wou ld not und ers tan d TR UE
SHIMMER to mean a precise gloss. There is nothing about a gloss to be precise. Consumers
would ascribe a different meaning to TRUE SHIMMER and thus it cannot be merely descriptive.
In fact, to support her position, the Examining Attorney asserts that TRUE SHIMMER is
descriptive of lip glos s. How eve r, App lic ant s goo ds are lip bal m, not lip glos s. Pote ntia l
consumers wou ld not asso ciat e the wor d S HI MM ER wit h lip bal m. It is hig hly unl ike ly that
consumers wou ld reg ard SH IM ME R as a desc ript ive char acte rist ic of lip bal m. Clea rly, a grea t
deal of imaginati on, tho ugh t and per cep tio n wou ld be req uir ed for the con sum er to rea ch any
conclusion about the nature of Applicants goods from the Mark.
Therefore, because Applicants Mark does not immediately convey information
concerning a sig nif ica nt qua lit y, cha rac ter ist ic, fun cti on, ing red ien t or fea tur e of App lic ant s
goods and a con sum er mus t eng age in a mul ti sta ge rea son ing pro ces s to rea ch a con clu sio n as to
the nature of the goo ds at issu e, the Mar k sho uld not be den ied regi stra tion as mer ely desc ript ive.
B. TRUE SHIMlVIER is Suggestive: It is a Double Entendre Susceptible
of Multiple Non-Descriptive Interpretations in Relation to Applicants Goods,
and The ref ore Sho uld Not Be Den ied Reg ist rat ion as Mer ely Des cri pti ve
As discussed in Section A above, a mark is merely descriptive and will be refused
registration if it imm edi ate ly con vey s inf orm ati on con cer nin g a sign ific ant qual ity, char acte rist ic,

Some marks classified as double entendres can be simultaneously be descriptive and
suggestiv e of an appl ican ts goo ds, bec aus e the y are subj ect to mul tip le feas ible inte rpre tati ons in
connection with the goo ds. A mar k that cons titu tes a dou ble ent end re is regi stra ble if [at leas t]
one of its mea nin gs is not mer ely desc ript ive in rela tion to the goo ds. TM EP § 121 3.0 5(c ); _se_e_
In re Simmon s Co. , 189 U.S .P. Q. 352 (TT AB 197 6) (re cog niz ing that TH E HA RD LIN E is not
merely descript ive of qual ity of matt ress , but is rath er sug ges tiv e of pro duc ts firm ness ); Tar e
Delaware Punch Co., 186 U.S.P.Q. 63 (TTAB 1975) (holding that THE SOFT PUNCH is not
merely des cri pti ve of non ca rbo nat ed sof t dri nk, but is ins tea d sug ges tiv e).
Because the boundary between the merely descriptive classification and the suggestive
category ca n req uir e the dra win g of fine line s and ofte n inv olv es a goo d mea sur e of sub jec tiv e
judgment. . .doubts are. . .resolved in favor of [a]pplicants. In re Conductive Sys, Inc.,220
U.S.P.Q. 84, 86 (TT AB 1983 ). Mor eov er, it is well set tled that rea son abl e dou bts as to a mar ks
suggestiveness or descri pti ven ess mus t be res olv ed in an App lic ant s fav or, and tha t the mar k
should be pub lis hed so that any per son who bel iev es that he or she wou ld be dam age d by
registra tion of the mar k can init iate oppo siti on. SE, gag In re Ata vio Inc. , 25 U.S .P. Q.Z d 136 1,

1987).
As deta iled in Sect ion A abov e, the Exa min ing Atto rney refu sed regi stra tion by assi gnin g

Mar k is subj ect to mer ely desc ript ive inte rpre tati on in con nec tio n wit h App lic ant s goo ds
namely , that on e of the feat ures of appl ican ts lip glo sse s is that the glos ses hav e a gen uin e
shine.
First, Applicant respectfully points out that Applicants goods are lip balms and not lip
gloss. Also, assuming arguendo that the Examining Attorneys descriptive interpretation of the
Mark is plausible, it is by no means the only valid interpretation. Multiple definitions of the
ter ms tru e and sh imm er crea te a dou ble ent end re whe n the Mar k as a who le is app lie d to
Applic ant s goo ds. The ref ore , as lon g as one of the Mar ks alte rnat ive mea nin gs is not mer ely
descriptive in relation to Applicants goods, the Mark is registrable. See TMEP § 1213.05(c).
In this case, the Mark has several suggestive meanings in relation to Applicants goods:
i. True Can be Interpreted to Mean Genuine
As pointed out by the Examining Attorney, the online version of Dictionary.com
provided by the Examining Attorney, among other things, defines true as genuine. See
pages from www,dictionarvcom (attached as Exhibit A). Based on these definitions, TRUE
SHIMMER may fairly be interpreted to mean a real shimmer. The resulting interpretation of
the Mark is in no way descriptive of Applicants goods, namely lip balm. Consumers who
encounter Applicants Mark in connection with Applicants goods will have to engage in a multi
stage reasoning process to understand the nature of Applicants goods based on the Mark. TRUE
SHIMMER may be understood to relate to a car, jewelry, glassware, or even an evening dress.
But is beyond the realm of possibility that when presented with the expression TRUE
SHIMMER that consumers would regard it as descriptive of lip balm.
Therefore, because this plausible interpretation of the Mark is suggestive, the Mark is not
merely descriptive of Applicants goods and should not be denied registration.
ii. True Can be Interpreted to Mean Steadfast
In addition to the term genuine, TRUE can mean steadfast. By combining the
definition of true with shimmer, TRUE SHIMMER can mean shimmer that lasts for a long
time and does not fade. This interpretation is as plausible as a real shimmer and renders the
Mark suggestive because a multi-stage reasoning process is required to understand the nature of
Applicants goods, the Mark is suggestive and should not be denied registration as merely
descriptive.
iii. True Can be Interpreted to Mean Pure
In addition to the term genuine and steadfast, TRUE can also mean pure. By
combining the definition of true with shimmer, TRUE SHIMMER can mean a pure
shimmer, or a perfect shimmer or nothing else but shimmer. Again, given this third plausible
interpretation, the Mark is not merely descriptive but clearly suggestive and inherently
registrable.
C. There are Numerous Third Party US. Trademark Registrations
on the Principal Register and Marks That Have Been Published and
Allowed That Include the Term TRUE Which Have Recognized That TRUE
Combined with a Descriptive Term Is Suggestive:
Numerous third party U.S. Trademark TRUE Registrations have issued on the
Principal Register without a disclaimer of TRUE or a showing of acquired distinctiveness. In
addition, U.S. trademark applications have been allowed and published without a disclaimer or
need to show secondary meaning. This is strong evidence that TRUE formative marks are
suggestive and inherently registrable because of the multiple plausible meanings of TRUE.

Considering the existence of these current and existing registrations and applications that
have been allowed, Applicant respectfully submits that its mark TRUE SHIMMER is also
entitled to registration on the Principal Register. If marks such as TRUE MOISTURE for skin
moisturizer, TRUE SHAVE for shaving products, TRUE RELIEF for pain relieving creams and
TRUE RED for red wine can be allowed as inherently registrable, then TRUE SHIMMER is
similarly entitled to be passed to publication.
D. The Internet Evidence Does Not Demonstrate That TRUE SHIMMER
is Used to Describe a Feature of Applicants Mark
The Examining Attorney utilized the search term true shimmer lip gloss to support her
position that TRUE SHIMMER is descriptive of Applicants goods. Moreover, the term lip
gloss is highlighted throughout the search. However, Applicants goods are lip balm, not lip
gloss, and the search conducted is thus not applicable to the subject Mark.
CONCLUSION
For all of the foregoing reasons, Applicant respectfully submits that TRUE SHIMMER is
not merely descriptive but is suggestive and respectfully requests that the refusal to register be
withdrawn and that this application be passed to publication.

RESPONSE TO OFFICE ACTION
Applicant, Wyeth, submits this response to the Office Action dated April 30, 2007 with
respect to TRUE SHIMMER (or the Mark) shown in Application Serial No. 77/094778.
1. Section 2ge1g11 Descriptive Refusal
The Examining Attorney has initially refused registration of Applicants proposed mark
TRUE SHIMMER (Mark) under Trademark Act Section 2(e)(l), 15 U.S.C. § 1052(e)(1)
because she believes the Mark merely describes a feature of the goods.
Applicant respectfully submits that its Mark is suggestive and not merely descriptive
because it does not immediately convey information concerning a significant feature of
Applicants goods. Rather, it requires a multistage reasoning process to reach a conclusion as to
the nature of Applicants goods. Also, Applicants Mark represents a double entendre
susceptible of multiple non-descriptive interpretations in relation to Applicants goods, further
supporting that it is suggestive. Moreover, there are numerous third party U.S. trademark
registrations on the Principal Register that contain the term TRUE together with another
descriptive term and it has long been the practice of the United States Patent and Trademark
Office to pass to publication TRUE marks used along with other descriptive terms because of
the many meanings and connotations of TRUE.
For all of the above reasons, Applicants Mark should not be denied registration on the
grounds that it is merely descriptive. Accordingly, Applicant respectfully requests that the
Examining Attorney reconsider her opinion and allow this application to be published.
A. TRUE SHIMMER Does Not Immediately Convey Information Concerning a
Signi?cant Feature of Applicants Goods and Therefore
Should Not Be Denied Registration as Merely Descriptive
A mark is merely descriptive and will be refused registration if it immediately conveys
information concerning a significant quality, characteristic, function, ingredient, or feature of the
goods. See In re MBNA America Bank, NA, 340 F.3d 1328, 67 U.S.P.Q.2d 1778 (Fed. Cir.
2003), reh g and rehg en banc denied, (Jan. 12, 2004) (holding that marks MONTANA SERIES
and PHILADELPHIA CARD used in connection with credit card services immediately convey
information about a specific regional affinity, or the user group to which services are directed);
In re Gmlay, 820 F.2d 1216, 3 U.S.P.Q.2d 1009 (Fed. Cir. 1987) (holding that mark APPLE PIE
is merely descriptive of potpourri because mark immediately conveys information about
potpourris scent); In re Bed & Breakfast Registry, 791 F.2d 157, 229 U.S.P.Q. 818 (Fed. Cir.
1986) (holding that BED & BREAKFAST REGISTRY is merely descriptive of lodging
reservation service that maintains registry of lodgings because registry is essential element of
applicants services); TMEP § 1209.0l(b). The perception of the relevant purchasing public sets
the standard for determining descriptiveness. E In re Nett Designs, 236 F3d. 1339, 1341 (Fed.
Cir. 2001). Thus, a mark is merely descriptive if the ultimate consumers immediately associate it
with a quality or characteristic of the product or service. ?. Conversely, a mark is not merely
descriptive if it requires imagination, thought or perception to reach a conclusion as to the nature
of the goods at issue. Id.
In the instant case, the Examining Attorney refused registration on the basis that
Applicants Mark merely describes a feature of Applicants goods. In support of her position
that the relevant purchasing public will immediately associate the Mark with a feature of
Applicants goods namely, lip balm, the Examining Attorney relies on only two definitions of
each of the terms that comprise the Mark. According to the Examining Attorney, the term true
describes something that is genuine or precise and the term shimmer describes a gloss or shine.
Therefore, true shimmer would be understood to describe a product that has a precise gloss.
In reaching this conclusion, the Examining Attorney simply ignores a myriad of
definitions of the terms that are re?ective of the publics understanding of the terms and thus the
Mark as a whole. For example, according to Dictionary.coms online dictionary, true has
numerous common defi niti ons incl udin g: gen uin e, stea dfas t, and prec ise. See pag es fro m
www.clictionar .corn attached hereto as Exhibit A.
In light of the multiple definitions associated with the terms comprising Applicants Mark
that shape con sum er per cep tio n of the Mar k as a who le, a con sum er con fro nte d wit h App lic ant s
Mark in connection with Applicants goods likely will be left wondering what TRUE
SHIM ME R is and ho w it rel ate s to App lic ant s goo ds of lip bal m. Con tra ry to the Exa min ing
Attorney s asse rtio ns, a pote ntia l con sum er alm ost cert ainl y wou ld not und ers tan d TR UE
SHIMMER to mean a precise gloss. There is nothing about a gloss to be precise. Consumers
would ascribe a different meaning to TRUE SHIMMER and thus it cannot be merely descriptive.
In fact, to support her position, the Examining Attorney asserts that TRUE SHIMMER is
descriptive of lip glos s. How eve r, App lic ant s goo ds are lip bal m, not lip glos s. Pote ntia l
consumers wou ld not asso ciat e the wor d S HI MM ER wit h lip bal m. It is hig hly unl ike ly that
consumers wou ld reg ard SH IM ME R as a desc ript ive char acte rist ic of lip bal m. Clea rly, a grea t
deal of imaginati on, tho ugh t and per cep tio n wou ld be req uir ed for the con sum er to rea ch any
conclusion about the nature of Applicants goods from the Mark.
Therefore, because Applicants Mark does not immediately convey information
concerning a sig nif ica nt qua lit y, cha rac ter ist ic, fun cti on, ing red ien t or fea tur e of App lic ant s
goods and a con sum er mus t eng age in a mul ti sta ge rea son ing pro ces s to rea ch a con clu sio n as to
the nature of the goo ds at issu e, the Mar k sho uld not be den ied regi stra tion as mer ely desc ript ive.
B. TRUE SHIMlVIER is Suggestive: It is a Double Entendre Susceptible
of Multiple Non-Descriptive Interpretations in Relation to Applicants Goods,
and The ref ore Sho uld Not Be Den ied Reg ist rat ion as Mer ely Des cri pti ve

Some marks classified as double entendres can be simultaneously be descriptive and
suggestiv e of an appl ican ts goo ds, bec aus e the y are subj ect to mul tip le feas ible inte rpre tati ons in
connection with the goo ds. A mar k that cons titu tes a dou ble ent end re is regi stra ble if [at leas t]
one of its mea nin gs is not mer ely desc ript ive in rela tion to the goo ds. TM EP § 121 3.0 5(c ); _se_e_
In re Simmon s Co. , 189 U.S .P. Q. 352 (TT AB 197 6) (re cog niz ing that TH E HA RD LIN E is not
merely descript ive of qual ity of matt ress , but is rath er sug ges tiv e of pro duc ts firm ness ); Tar e
Delaware Punch Co., 186 U.S.P.Q. 63 (TTAB 1975) (holding that THE SOFT PUNCH is not
merely des cri pti ve of non ca rbo nat ed sof t dri nk, but is ins tea d sug ges tiv e).
Because the boundary between the merely descriptive classification and the suggestive
category ca n req uir e the dra win g of fine line s and ofte n inv olv es a goo d mea sur e of sub jec tiv e
judgment. . .doubts are. . .resolved in favor of [a]pplicants. In re Conductive Sys, Inc.,220
U.S.P.Q. 84, 86 (TT AB 1983 ). Mor eov er, it is well set tled that rea son abl e dou bts as to a mar ks
suggestiveness or descri pti ven ess mus t be res olv ed in an App lic ant s fav or, and tha t the mar k
should be pub lis hed so that any per son who bel iev es that he or she wou ld be dam age d by
registra tion of the mar k can init iate oppo siti on. SE, gag In re Ata vio Inc. , 25 U.S .P. Q.Z d 136 1,
1363 (TTAB 199 2); In re Int ell ige nt Med ica l Sys tem s, Inc. , 5 U.S .P. Q.2 d 167 4, 167 6 (T TA B
1987).

Mar k is subj ect to mer ely desc ript ive inte rpre tati on in con nec tio n wit h App lic ant s goo ds
namely , that on e of the feat ures of appl ican ts lip glo sse s is that the glos ses hav e a gen uin e
shine.
First, Applicant respectfully points out that Applicants goods are lip balms and not lip
gloss. Also, assuming arguendo that the Examining Attorneys descriptive interpretation of the
Mark is plausible, it is by no means the only valid interpretation. Multiple definitions of the
ter ms tru e and sh imm er crea te a dou ble ent end re whe n the Mar k as a who le is app lie d to
Applic ant s goo ds. The ref ore , as lon g as one of the Mar ks alte rnat ive mea nin gs is not mer ely
descriptive in relation to Applicants goods, the Mark is registrable. See TMEP § 1213.05(c).
In this case, the Mark has several suggestive meanings in relation to Applicants goods:
i. True Can be Interpreted to Mean Genuine
As pointed out by the Examining Attorney, the online version of Dictionary.com
provided by the Examining Attorney, among other things, defines true as genuine. See
pages from www,dictionarvcom (attached as Exhibit A). Based on these definitions, TRUE
SHIMMER may fairly be interpreted to mean a real shimmer. The resulting interpretation of
the Mark is in no way descriptive of Applicants goods, namely lip balm. Consumers who
encounter Applicants Mark in connection with Applicants goods will have to engage in a multi
stage reasoning process to understand the nature of Applicants goods based on the Mark. TRUE
SHIMMER may be understood to relate to a car, jewelry, glassware, or even an evening dress.
But is beyond the realm of possibility that when presented with the expression TRUE
SHIMMER that consumers would regard it as descriptive of lip balm.
Therefore, because this plausible interpretation of the Mark is suggestive, the Mark is not
merely descriptive of Applicants goods and should not be denied registration.
ii. True Can be Interpreted to Mean Steadfast
In addition to the term genuine, TRUE can mean steadfast. By combining the
definition of true with shimmer, TRUE SHIMMER can mean shimmer that lasts for a long
time and does not fade. This interpretation is as plausible as a real shimmer and renders the
Mark suggestive because a multi-stage reasoning process is required to understand the nature of
Applicants goods, the Mark is suggestive and should not be denied registration as merely
descriptive.
iii. True Can be Interpreted to Mean Pure
In addition to the term genuine and steadfast, TRUE can also mean pure. By
combining the definition of true with shimmer, TRUE SHIMMER can mean a pure
shimmer, or a perfect shimmer or nothing else but shimmer. Again, given this third plausible
interpretation, the Mark is not merely descriptive but clearly suggestive and inherently
registrable.
C. There are Numerous Third Party US. Trademark Registrations
on the Principal Register and Marks That Have Been Published and
Allowed That Include the Term TRUE Which Have Recognized That TRUE
Combined with a Descriptive Term Is Suggestive:
Numerous third party U.S. Trademark TRUE Registrations have issued on the
Principal Register without a disclaimer of TRUE or a showing of acquired distinctiveness. In
addition, U.S. trademark applications have been allowed and published without a disclaimer or
need to show secondary meaning. This is strong evidence that TRUE formative marks are
suggestive and inherently registrable because of the multiple plausible meanings of TRUE.

have been allowed, Applicant respectfully submits that its mark TRUE SHIMMER is also
entitled to registration on the Principal Register. If marks such as TRUE MOISTURE for skin
moisturizer, TRUE SHAVE for shaving products, TRUE RELIEF for pain relieving creams and
TRUE RED for red wine can be allowed as inherently registrable, then TRUE SHIMMER is
similarly entitled to be passed to publication.
D. The Internet Evidence Does Not Demonstrate That TRUE SHIMMER
is Used to Describe a Feature of Applicants Mark
The Examining Attorney utilized the search term true shimmer lip gloss to support her
position that TRUE SHIMMER is descriptive of Applicants goods. Moreover, the term lip
gloss is highlighted throughout the search. However, Applicants goods are lip balm, not lip
gloss, and the search conducted is thus not applicable to the subject Mark.
CONCLUSION
For all of the foregoing reasons, Applicant respectfully submits that TRUE SHIMMER is
not merely descriptive but is suggestive and respectfully requests that the refusal to register be
withdrawn and that this application be passed to publication.
